What should I do if I lose the Hong Kong trademark certificate?

First of all, we need to know that the Hong Kong Intellectual Property Department will not reissue Hong Kong certificates to applicants, and the certificates will only be issued once.

We have two ways to solve this problem 1) Request for a Certified True Copy and 2) Download the Trademark information from the official website of the Hong Kong Intellectual Property Department.



1)Request for a Certified True Copy


Suppose the trademark certificate is lost in Hong Kong. In that case, we can only ask the Hong Kong Intellectual Property Department to request a replacement certificate called the Certified True Copy of the certificate. The official fee is HK$150. The Intellectual Property Department will issue this certificate with a watermark and the enclosed letters are marked with a Copy.

The Certified True Copy will be stamped with the Hong Kong Registrar of Trade Marks.


Information required:

-T14 form (Request for Certified Copy)

-Registration number and the applicant

-How many copies are needed


We could file the T14 form via the Hong Kong e-filing system or by paper form. We need to wait about two weeks to collect the document. Upon completion, the staff of the Hong Kong Intellectual Property Department will contact the applicant directly by phone call. The applicant should visit the office of the Hong Kong Intellectual Property Department in Wan Chai to pick up the documents.


On the other hand, we, Patent and Design Limited guarantee that our clients will receive the Certified True Copy within three weeks on their hands because we aim to provide prompt and accurate services to all of our clients.


Tips: If you want to claim the trademark priority in foreign countries within six months, you may also need to request this Certified True Copy to submit to the foreign trademark offices.



2) Download the Trademark information from the official website of the Hong Kong Intellectual Property Department


Another solution is to go to the Hong Kong Intellectual Property Department to view the pdf of the original information which is free to download the pdf file. As for self-archiving, please check the link of the Hong Kong Intellectual Property Department: https://esearch.ipd.gov.hk/nis-pos-view/#/.


Steps:


1. Choose 'Search for the trademark'

2. Fill in any information is related to your trademark (such as registration number/application number)

3. In the upper column, click 'Download' to capture the entire trademark information for archiving


Tips: The above action is really fast so we do not need to wait until the working time of the Trademark Office. The downloaded information is also the same as the original trademark information, therefore, if you only want to have the trademark information for your proof, you could simply do that for your convenience.


There are two options, 1) download the pdf version on the official website or 2) require the official Certified True Copy version. However, this pdf version must have slightly different from the original version, and a 'Copy' mark will be shown in the Certified True Copy version.
